AbstractTrust-based e-assessment systems are increasingly important in the digital age for both academic institutions and students, including students with special educational needs and disabilities (SEND). In this work, we want to try to examine what might be – today – the consequences of a contrast between the national legislation, artt. 51 and 52 of 30 June 2003, n. 196 (so-called Privacy Code) and art. 17 of the d.P.C.M. of 16 February 2016, n. 40, and the European legislation, art. 55 of the Privacy Regulation of 25 May 2016, n. 679, regarding the relationship between the protection of personal data, the right of access to the deeds of the electronic file of the administrative process by third parties (here of interest to journalists) and the right to information.

Purpose: The aim of the article is to analyse the processing of personal data of air passengers during the SARS-CoV-2 pandemic in the context of doubts that have arisen in connection with the need for these passengers to provide their personal data as part of filling out the Passenger Location Card questionnaire. Method: The research method used in this study is case study. The operation of new technologies and the supply of digital goods involves for users to disclose their personal data. The market data is already a reality with the danger that this entails for the privacy of citizens. The new General Data Protection Regulation has created a new legal framework that aims to radically change the current model, giving users greater powers to control their data. A good example of this is the express statement, and for the first time, of the right to be forgotten, which allows citizens to digitally erase their data when other fundamental rights are endangered.

Electronic Health Record in Italy and Personal Data Protection.

The present article deals with the Italian Electronic Health Record (hereinafter ehr), recently introduced by Act 221/2012, with a specific focus on personal data protection. Privacy issues — e.g., informed consent, data processing, patients’ rights and minors’ will — are discussed within the framework of recent e-Health legislation, national Data Protection Code, the related Data Protection Authority pronouncements and eu law. The paper is aimed at discussing the problems arising from a complex, fragmentary and sometimes uncertain legal framework on e-Health.

Internet e tutela dei dati personali: il consenso ai cookie

The article tackles the issue of protection of personal data of internet users through the usage of cookies by digital content and service providers. It analyses the European legislative framework and, in particular, the General Data Protection Regulation, the so called E-Privacy Directive and the new Directive concerning the supply of digital content and services. The contribution debates the role of individual consent in this field and the interaction with the rules and the remedies provided by European Consumer Law, such as the Unfair Commercial Practices Directive, in order to protect user's personal data in the evolution of data-driven economy.
